FIELD SOBRIETY TESTS – WHAT IF POLICE DO NOT COMPLY WITH NHTSA REQUIREMENTS?
The National Highway Traffic Safety Administration (NHTSA) has developed a series of “standardized” field sobriety tests for police to administer at roadside. An officer's failure to substantially comply with NHTSA protocol when administering the tests can result in the sobriety tests, as well as evidence obtained after arrest, being excluded.
